Terms & Conditions of Booking

Stay at Delmare is the booking website of Delmare at Buye Beach ("Delmare", "we"), which operates Delmare at Buye Beach and Delmare Rooftop at Camino Buye, El Cerro, Cabo Rojo, PR 00623.

These terms apply to reservations made directly on this website and to payments made through payment links we send you. Reservations made on Airbnb, VRBO, Booking.com or Join a Join are governed by that platform's terms; our House Rules apply to every stay, whichever way you booked.

A reservation is confirmed only when full payment has been received and we send you a confirmation with your reservation code. Until then, dates may be held for a short time while you pay, but are not guaranteed.

• The person who books must be at least 21 years old, must stay at the property and is responsible for everyone in the group.
• Each home sleeps a maximum of 6 guests. Only the guests included in the reservation may stay overnight.
• Please check your dates, number of guests and contact details before paying: we use them to send your door code and arrival information.

Prices are in US dollars. Before paying you'll see the full breakdown: nightly rate, cleaning fee, any additional-guest fee and the Puerto Rico room tax (7%), which we collect and remit as required by law.

• Direct reservations are paid in full at the time of booking.
• Payments are processed by Stripe. We never see or store your full card number.
• Payment links we send (for example, for a Booking.com reservation with payment at the property, a deposit, a balance or an additional charge) show the amount, the concept and the date until which the link is valid. A balance that is not paid by its due date may lead to the cancellation of the reservation under the policy that applies to it.

Cancellations and refunds follow our Cancellation & Refund Policy. Changes of dates or guests are subject to availability and to the price difference, if any.

• Check-in is from 4:00 PM and check-out is before 11:00 AM.
• Check-in is self-service with a keypad code that we send before your arrival. Please don't share the code.
• Early check-in or late check-out can be requested and depends on availability; an additional charge may apply.
• You agree to follow the House Rules. Serious or repeated breaches (for example, a party or exceeding the maximum occupancy) may lead to the end of the stay without a refund.

You're responsible for damage to the home, its furniture or equipment caused during your stay by you or your group, beyond normal wear. If that happens, we'll contact you with a description and photos and may charge the reasonable cost of repair or replacement, or an additional cleaning fee if the home is left in a condition that requires it.

Electricity, water and internet in Puerto Rico are provided by third parties and are occasionally interrupted. These interruptions are outside our control: we'll do everything reasonable to help and to restore service as soon as possible, but they don't by themselves give the right to a refund. If an interruption makes the home uninhabitable in our reasonable judgement, we'll refund the affected nights.

• Buyé Beach is a public beach with no lifeguard service. Sea conditions can change quickly: swim within your ability and always supervise children in and near the water.
• Balconies and terraces have glass railings. Don't climb or sit on them, and don't leave children unattended on them.
• Use of the beach, the sea and the home's outdoor areas is at your own risk, except for damage caused by our negligence as provided by law.

If the National Weather Service issues a hurricane or tropical storm warning for western Puerto Rico, or the authorities order an evacuation, that affects your dates, you may move your reservation to other available dates or receive a refund for the unused nights. We're not responsible for failures caused by events beyond our reasonable control, such as natural disasters, government orders or large-scale outages.

We may enter the home during your stay to carry out urgent repairs or in an emergency. For any other maintenance we'll ask you first and agree on a time.

To the extent permitted by Puerto Rico law, our liability for any claim related to a reservation is limited to the amount you paid for it. We're not responsible for personal belongings lost, stolen or left behind; if we find something, we'll let you know.

These terms are governed by the laws of the Commonwealth of Puerto Rico. Any dispute will be heard by the courts of Puerto Rico, without affecting any mandatory rights you have as a consumer.
